House OKs Bill Requiring Bond in Radiation Stays

The House passed a bill Wednesday that could require the posting of a bond if a stay is sought in a case before the Utah Radiation Control Board.

Under HB335 — sponsored by Rep. Aaron Tilton, R-Springville — the Radiation Control Board would hold a hearing to decide whether to require a bond.

Previous versions of the bill required the bond regardless.

Tilton said the bill complies with the federal authority granted to the state from the Nuclear Regulatory Commission.

Minority Leader Rep. Ralph Becker, D-Salt Lake, said the bill is the third in a series of measures that would restrict access to the courts by requiring plaintiffs to post bonds in order to sue.

Opponents of HB335 argued that the legal right to appeal to a court hinges upon exhausting administrative remedies available, and if a bond is required for that remedy, it reduces access to courts.

Rep. Ross Romero, D-Salt Lake, said the bill would let the fox guard the henhouse, if a challenge is launched against a board decision.

Tilton said in some cases, damages could be significant if a stay is granted and a bond is not required.

HB335 advanced 45-25 to the Senate.
